Motions for temporary injunction halting salary hikes denied

Craig Bucki represented the City of Buffalo in a lawsuit that challenged a 12.63% pay raises for the Buffalo Mayor, Common Council and other elected city officials. The suit was dismissed by a New York State Supreme Court Justice in which the judge denied motions for a temporary injunction halting salary hikes that went into effect January 1, 2024, and a judgment to invalidate the local law that made the raises possible. The judge dismissed the lawsuit on two grounds: 1.) the coalition that brought the lawsuit did not comply with the four-month statute of limitation for filing its petition, and 2.) the city’s Citizens Salary Review Commission is not a public body subject to the Open Meetings Law.
